    Planning permission was granted at the planning meeting of Sefton Council on February 7th for change of use of Unit 11 to takeaway / hot food takeaway to be occupied by McDonald's.

    Several conditions were made, mainly to safeguard the living conditions of neighbouring occupiers and land users.

    Recommendation - Approve with Conditions

    Time Limit for Commencement

    1) The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.
    Reason: In order that the development is commenced in a timely manner, as set out in Section 91 of the Town and Country Planning Act 1990 (as amended).

    Approved Plans

    2) The development shall be carried out in accordance with the following approved plans and documents:

    13161_AEW_2095_004C Proposed Site Plan
    13161_AEW_2095_005C Existing and Proposed Building Elevations
    13161_AEW_2095_0019A Proposed Fence and Gate Details

    13161_AEW_2095_0006A Existing and Proposed Building Floor and Roof Plan

    Reason: For the avoidance of doubt.

    Before the Development is Occupied

    3) Prior to the commencement of use, the fencing and gates to the side shall be implemented in accordance with drawing no 13161_AEW_2095_0019A. The fence and gates shall be colour coated black. They shall be retained, and the enclosed area used for staff parking and servicing only throughout the life of the development.
    Reason: To safeguard the living conditions of neighbouring occupiers and land users.

    4) The mitigation measures contained within the Odour Control Assessment report (230926 September 2023) and Plant Noise Assessment report (7880 Rev 3 16th October 23) shall be implemented prior to the commencement of use and adhered to throughout the life of the development.
    Reason: To prevent unreasonable odours, noise and disturbance to neighbouring occupants in the interests of residential amenity.

    5) Prior to the commencement of use a scheme for the provision of litter bins shall be submitted to and approved in writing by the local planning authority. The approved scheme shall be implemented prior to the to the commencement of use and the litter bins retained to throughout the life of the development.
    Reason: In the interests of amenity and to protect the character of the area.

    Ongoing Conditions

    6) Customers are not permitted on the premises and food and drink collections are not permitted at any time outside the hours of 06.00 to 23.00.
    Reason: To safeguard the living conditions of neighbouring occupiers and land users.

    7) Deliveries are not permitted on the premises at any time outside the hours of 17.00 to 21.00.
    Reason: To safeguard the living conditions of neighbouring occupiers and land users.

    I suppose it's likely some less than-wonderful customers will leave at 11pm clutching their calories and then lob around the car park for an hour doing who knows what?

    Wouldn't like to be a neighbour.
