    A group of travellers have set up camp on the little used Fairways park and ride. They appear to have gained entry by forcing one of the gates open.

    If it’s true that they have forced a gate to gain entry, they should be arrested for breaking and entering.

    I think know the answer to this one. The Police turn up and ask, "Who cut the lock off/forced the gate" ? Person sitting in deckchair by caravan says, "It wasn't me, it was already like that when I got here, I don't know who did it". Usually followed by "You lot are always picking on us, why don't you leave us alone", (this response has been heavily censored). No witnesses or evidence and DEFINITELY no confession. Who are you going to arrest, it's either everyone or no one. And unless the they were being filmed by a News crew at the time the damage was being done the CPS won't touch it with a bargepole.

    My exasperation knows no bounds there's always some numpty who trumpets 'criminal damage' or 'breaking and entering' - it isn't going to happen and for one very good reason - NO EVIDENCE. A quaint notion - often viewed as a cornerstone of our legal system.

    And the defendants may well point to another local news site reporting that the gate was left open by a security guard that doesn't exist.

    They need to get the Police from Lytham to sort this out.

    One of the schools in Lytham had travellers on their car park last week and the Lytham Police moved them on in a matter of hours

    It should be recognised that where there is a gate or barrier on a piece of land or any such area - no matter if it is locked or not - it indicates that it is private land!
    Anyone ignoring this should be arrested for trespass whether it be one person or a hundred!

    The sole offence of trespass is a civil matter, not a criminal one, so you can’t be arrested for it, unless there is an intent to cause criminal damage.
