You are not allowed to carry passengers in a caravan whilst it is being towed, so there would be no occupants.
The Alko coupling is the raised (unlocked) position which indicates the caravan may not have been correctly connected to the towbar, and the lack of skid marks indicates that the breakaway cable (which activates the caravan brakes in the event of a detachment) may not have been correctly connected.
The owner may have a problem with insurance.

How do we know it wasnt a idiotic cyclist trying to tow this behind his bike while texting, speeding and with no hands on the handlebars?

You know there might be something in the cyclist theory - after all the caravan does appear to be on the footpath!
